Bankruptcy fraud is observed everywhere around the world. It happens when the debtor or a professional abuses the bankruptcy procedure. The whole system of bankruptcy relies on good faith it undermines the idea that those who loan money should also be repaid. But sometimes people misuse the whole bankruptcy system.
The bankruptcy fraud can be observed in various shapes. It can be the case when the debtor hides his financial assets in order to save them or the individual keeps his assets secret so that during bankruptcy those assets are not withdrawn from him. Another case of false bankruptcy can be observed when the individual does not provide complete information regarding his debts and related facts so that they can get benefit out of it. People use different methods to do frauds related to bankruptcy and all is done so that they can gather benefit from this crime.
One other way of doing bankruptcy fraud is to file for bankruptcy at more than one state at the same time, what happens is that the individuals provides files from multiple locations so that he can get compensation from multiple locations as well. The information provided by the individuals can either be true or false some people provide false information and apply at different multiple locations to get benefit from the bankruptcy system. Or it may be the case where the individual bribes the appointed court trustee or other officials so that they approve his file for bankruptcy.
Bankruptcy fraud can also lead to various other frauds and serious crimes. It is a way that leads to crimes like; identity theft, mortgage fraud, money laundering and corruption. Over the years there has been a gradual increase in the number of cases filed for bankruptcy and a large percentage of these cases are suspected as frauds. It is necessary to do something against the fraudsters in order to avoid this crime from spreading.
In order to avoid frauds related to bankruptcy the officials can target individuals and businesses that hide their assets and do not reveal their overall financial assets. Also target those individuals and businesses who file for bankruptcy at multiple locations during the same time period and also target those businesses who are involved in other crimes related to bankruptcy. It is required to investigate each and every case filed for bankruptcy very thoroughly in order to avoid any mishaps from happening.
Lastly, bankruptcy fraud is a matter of very high concern therefore it should be highlighted and the public’s attention should be dragged to this problem as this problem implies a great impact on the overall economy. Abuse of this system by anyone is a very serious crime and something should be done about it to stop it from happening. The basic purpose of bankruptcy system is to give individuals and businesses a second chance to establish their financial affairs. Therefore any person who abuses this system should be punished severely.
